Desert Mediation Group offers mediation in any of three modalities:
Facilitative mediators hold joint sessions with all parties present so that the parties can hear each other's points of view, but hold caucuses regularly.
Evaluative mediators meet most often in separate meetings with the parties and their attorneys, practicing “shuttle diplomacy”.
Transformative mediation is based on the values of "empowerment" of each of the parties as much as possible, and "recognition" by each of the parties of the other parties' needs, interests, values and points of view. The potential for transformative mediation is that any or all parties or their relationships may be transformed during the mediation.
Transformative mediators meet with parties together, since only they can give each other "recognition".Litigation is costly and time-consuming. Mediation, by contrast, is relatively inexpensive and often results in the resolution of your case in one day or less. Most lawsuits and real estate disputes can effectively and efficiently be resolved by mediation with a third party facilitator.
Mediation is a neutral process. The information shared in a mediation session is confidential unless the parties jointly agree otherwise. The mediation process often involves frank discussion of the strengths and weaknesses of your dispute with a seasoned legal professional. As mediators, we facilitate the discovery of grounds for compromise and, often grudging, agreement.
